1. Introduction

Welcome to imgup.uk ("we", "us", "our", "the Service"). By using our image hosting service, you agree to these Terms of Service and Acceptable Use Policy ("Terms").

If you do not agree to these Terms, you must not use the Service.

2. Service Description

imgup.uk is an image hosting service. We provide:

  • Image upload and storage via API or direct drag & drop
  • Public viewer pages for uploaded images
  • Direct image links for embedding
  • Album creation and management
  • Integration with third-party tools (e.g., ShareX)

Access Model: imgup.uk provides both public uploads (via the website) and private uploads (via API key for programmatic access such as ShareX). All users are equally bound by these Terms.

3. Acceptable Use

You agree that you will NOT upload, store, or share content that:

  • Is illegal under UK law or the law of your jurisdiction
  • Depicts or promotes child sexual abuse material (CSAM)
  • Infringes copyright, trademark, or other intellectual property rights
  • Contains malware, viruses, or malicious code
  • Promotes violence, terrorism, or hate speech
  • Violates privacy rights of others
  • Depicts non-consensual sexual acts or "revenge porn"
  • Contains extreme or obscene content prohibited under the Obscene Publications Act 1959
  • Is obscene, defamatory, or harassing
  • Attempts to circumvent our security measures or rate limits

4. Adult / NSFW Content

You may upload NSFW (Not Safe For Work) or adult-oriented material only if it is legal under UK law and does not depict or promote:

  • Child sexual abuse material (CSAM)
  • Non-consensual sexual acts or "revenge porn"
  • Extreme or obscene content prohibited under the Obscene Publications Act 1959
  • Real acts of harm or violence

You understand that imgup.uk is a hosting-only service with no public galleries. Uploaded content is only accessible via direct link.

Responsibility for sharing, distributing, or embedding such links rests solely with the uploader.

We do not verify or curate uploads but reserve the right to remove content reported as illegal or inappropriate.

5. Your Responsibilities

By uploading content, you confirm that:

  • You own the content or have the necessary rights to upload it
  • Your content complies with these Terms and all applicable laws
  • You will not share your API key with unauthorized parties (if applicable)
  • You accept responsibility for all content uploaded with your API key or account
  • You will not use the Service to distribute illegal or harmful content

6. Content Moderation & Removal

Important: We do not monitor or pre-screen uploads. Content is user-generated and hosted privately unless shared via direct link.

We reserve the right to:

  • Review any uploaded content when reported
  • Remove content that violates these Terms
  • Disable or delete content in response to valid reports
  • Suspend or terminate user accounts for violations
  • Log cryptographic hashes of reported images to detect re-uploads of illegal content (CSAM)
  • Cooperate with law enforcement and regulatory authorities

Users may report abuse via our Report Abuse page. We aim to review reports within 24 hours.

7. Intellectual Property

You retain ownership of content you upload. By using the Service, you grant us a non-exclusive, worldwide license to store, display, and deliver your content as necessary to operate the Service.

The Service itself, including our branding, code, and design, remains our property.

8. Privacy & Data Protection

Our collection and use of personal data is governed by our Privacy Policy.

We comply with UK GDPR and data protection law. We log minimal data necessary for Service operation and abuse prevention.

9. Service Availability

We may temporarily suspend or limit access for maintenance, upgrades, or technical issues.

We are not responsible for downtime or data loss caused by third-party hosting providers (IONOS, Cloudflare, etc.) or events beyond our reasonable control.

10. Disclaimers & Limitations

The Service is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free operation
  • Permanent storage of your content
  • Security against all threats
  • Compatibility with all third-party tools

We are not liable for: loss of data, business interruption, indirect damages, or content uploaded by users.

To the maximum extent permitted by law, our total liability is limited to the fees paid (if any) for the Service.

11. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Content you upload or share
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Child Safety

We operate a zero-tolerance policy for child sexual abuse material (CSAM).

If you encounter CSAM on our Service:

We will take immediate action and report to the appropriate authorities (e.g., National Crime Agency, Internet Watch Foundation).

13. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the new Terms.

Significant changes will be communicated via email to registered users.

14. Termination

We may terminate or suspend your access at any time, with or without notice, for violations of these Terms or for any other reason.

You may stop using the Service at any time. Contact us to request deletion of your data.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
